Release & Waiver of Liability – 2018
Abu Mu’aaz Hajj & Umrah Tours, a Hajj & Umrah Agency, is an exceptional and extraordinary Tour Operator and assures and pledges that any services provided will be to the customer’s utmost satisfaction. Hajj & Umrah is challenging. The journey involves many factors, from Airlines, Hotels, Transport Companies, Mutawwefs, and most importantly, the Saudi Government. Since this is a very complicated and complex journey, most insurance companies refuse to insure such travelers.
Abu Mu’aaz Hajj & Umrah Tours has always vowed to excel in its duties and perform its best and to provide comfort and convenience to all Hajj & Umrah passengers so that they may have a blessed Hajj & Umrah. But this journey is not without certain risks, dangers, and hazards to all participants. Therefore, all individuals must read this document and sign it before departure for their benefit and protection and the protection of Abu Mu’aaz Hajj & Umrah Tours and its Suppliers. These terms and conditions are part of our agreement, even if you do not sign a printed copy. So please read and understand that you are bound by this agreement and conditions when you sign up with Abu Mu’aaz for the Hajj or Umrah.
The responsibility of Abu Mu’aaz Hajj & Umrah Tours as a tour operator is limited. Abu Mu’aaz Hajj & Umrah Tours, located at 72-24 Broadway, Jackson Heights, Queens, New York 11372 USA, acts only in making arrangements for airlines, hotels, buses, or any other services connected with HAJJ and UMRAH travel. Abu Mu’aaz Hajj & Umrah Tours assumes no liability whatsoever for injury, damage, loss, accident, delay, or irregularity which may be occasioned either because of defect, through the acts or defaults of any company or person engaged in conveying passengers or in carrying out the arrangements of the tour, or any natural disaster, dangerous incident in the air, sea, land, fire, breakdown of machinery or equipment, acts of government or other authorities de jure or de facto, wars, whether declared or not, hostilities, civil disturbances, strikes, riots, theft, pilferage, epidemics, quarantines, medical or customs regulations, or from improper passports, visas or other documents. Abu Mu’aaz Hajj & Umrah Tours will accept no responsibility for loss or additional expenses due to delay or changes in schedule, or other causes. Abu Mu’aaz Hajj & Umrah Tours shall not be liable or responsible for any inconvenience, loss, damage, or injury arising in connection with such services. Abu Mu’aaz Hajj & Umrah Tours shall not be responsible for any person or persons missing any part of the program due to their negligence or delay, or absenteeism for any time during the tour. It will not be responsible for any additional expenses for the participant to rejoin the tour. Moreover, no refunds will be given for services not utilized.
A minimum deposit of US$3500 per person for Hajj is required for reservation. For Umrah only it is $1500.
All cancellations 60 days or less before departure, for HAJJ only, shall be subject to US$1500 administrative charges. For cancellations, 45 days or less before the departure shall be subject to US$2000 administrative charges, and cancellations 30 days before departure shall be subject to $3000 administrative costs. There will be no refund if cancellation is less than 21 days before departure. All fees mentioned in this memo or any Hajj Flyer by Abu Mu’aaz are US dollars. These charges are in addition to any other airline penalties, etc.
Hajj tickets are non-refundable once issued. Cancellation after tickets are issued, is subject to additional penalties. All Hajj and Umrah Packages do not include Airline fuel surcharge and any sudden airline fare increases due to fuel costs and government-imposed taxes. If any passenger misses their flight due to negligence, that passenger shall bear the additional expenses to rebook flights, book hotels, and transportation. Should this occur, then passengers are required to pay the difference. The Kingdom of Saudi Arabia has recently, in Feb 2018, imposed 5% municipality taxes and 5% VAT, and all Hajjis are required to pay the government-imposed taxes in addition to the Hajj or Umrah Package rates. It is calculated depending on the package rates as US$300.00 per person.
A partial refund may be allowed less than 21 days before departure, BUT under no circumstances will any refund be given after HAJJ VISA is issued. These rules also apply to Ramadan Umrah and any high season Umrah. No refund after the visa is issued. Visas cannot be substituted, and Hajj-related payments are deducted electronically by the Saudi Ministry of Hajj and cannot be reimbursed.
Travel Insurance may be a good idea for those who fear illness or anticipate any setbacks. Abu Mu’aaz Hajj & Umrah Tours do not sell Travel Insurance.
